The Republic of Moldova is currently a developing country and there still remains a need to support the economy and adjust the standardization activity in order to meet the increasing demands of the market and society.

The central specialized body from the public administration responsible for the quality infrastructure is the Ministry of Economy. In conformity with the Law on national standardization Nº 20 of 2016.03.04, the Ministry of Economy establishes the standardization policy.

In January 2013, the National Institute for Standardization and Metrology of Moldova (INSM) was reorganized and split into two separate institutions: the National Institute for Standardization (INS) and the National Metrology Institute (INM).

In the Republic of Moldova, a new law that provides the legal framework for the national standardization activities has been approved. According to it, the National Institute for Standardization (INS) has changed its name to Institute for Standardization of Moldova, with the following short name – ISM.

ISM is a public institution and has the following main functions:

cooperates with the regulatory authorities and with other interested parties and includes, as a priority, their requests in the National Standardization Program;

provides information, on request, to the regulatory authorities, technical committees and other interested parties regarding the stage of development, approval, reconfirmation, modification and cancellation of the normative documents included in the national standardization program, as well as regarding the standardization activity in all the regulated fields;

works together with the regulatory authorities on the withdrawal of conflicting national standards;

adopts international, European, interstate and other countries' standards as Moldovan standards.

Moldova is led by the National Institute for Standardization (ISM).

Moldova is a WTO member country (WTO member since July 26, 2001 and, accordingly, fulfills the provisions of the WTO Agreement on Technical Barriers to Trade (TBT) and the WTO Agreement on Sanitary and Phytosanitary Measures (SPS).

The issues of technical regulation and standardization in Moldova are carried out by the National Institute for Standardization (ISM).

ISM is the national standardization body of Moldova and represents the country as a member of European, international and interstate standardization organizations.

National standards of Moldova (SM) are based on international standards, European standards, standards of other countries. More than 7 thousand interstate standards (GOST) and about two hundred original national standards are in force in Moldova. In accordance with the current law of the Republic of Moldova "On national standardization" dated 04.02.2016 No. 20, the application of standards is voluntary, unless otherwise stipulated in legislative acts, technical regulations or in contracts of economic entities. About 95% of the EU standards that apply to the application of the EU New Approach directives have already been adopted as national standards in the Republic of Moldova.

The Law of the Republic of Moldova of 22.12.2006 No. 420 "On Technical Regulation" establishes general requirements for the content and procedure for the development, publication and application of technical regulations.

Technical regulations are developed taking into account the harmonization of national legislation with EU and international legislation. The technical regulations of Moldova can be found at: http://estandard.md/Regulation/RegulationSearch.

For areas in which there is harmonized European Union legislation (New Approach Directives), national technical regulations are based on this legislation.

After the entry into force of the Law of 22.12.2006 no. 420 "On technical regulation" the list of goods subject to mandatory conformity assessment in Moldova is not applied.

Product safety, which is not covered by the technical regulations of Moldova, is regulated within the framework of the Law On General Product Safety.

For products falling within the areas of EU harmonized legislation, the following conformity assessment procedures are defined in the European Parliament and Council Decision no. 768 [4] and applied in the EU. They provide for each product category one module or a corresponding combination of the following modules:

a) module A - internal production control;

b) Module A1 - Internal production control and controlled product testing;

c) module A2 - internal production control and controlled product inspections at arbitrary intervals;

d) module B - testing of a type sample of products for compliance with European requirements;

e) module C - conformity to the product type based on internal production control;

f) module C1 - conformity to the type sample of products based on internal production control and controlled testing of the product;

g) module C2 - conformity to the type sample of products based on internal production control and controlled checks of the product at arbitrary intervals;

h) module D - conformity to the product type based on quality assurance of the manufacturing process;

i) Module D1 - Manufacturing Quality Assurance;

j) Module E - conformity to the product type based on product quality assurance;

k) Module E1 - Quality Assurance in the Inspection and Testing of the End Product;

l) Module F - conformity to the type based on product verification;

m) Module F1 - Compliance Based on Product Verification;

n) Module G - Compliance based on unit verification;

o) Module H - Compliance Based on Full Quality Assurance;

p) Module H1 - Compliance Based on Full Quality Assurance and Design Review.

 Products subject to conformity assessment in the regulated area, prior to their introduction on the market, are marked by the manufacturer with the SM (Standard moldovenescu) conformity mark, if the technical regulations provide for such marking. The SM marking indicates its compliance with the basic requirements established by technical regulations based on harmonized Community legislation (Figure 1).

The certificates of conformity or test reports issued by notified conformity assessment bodies of other countries, based on bilateral agreements on mutual recognition of conformity assessment activities, are recognized. Recognition of certificates of conformity is carried out by issuing a new certificate of conformity by certification bodies accredited by the National Center for Accreditation.

In the process of recognition, the certification body may establish the need for additional tests if the basic requirements in force in the Republic of Moldova do not meet the requirements specified in the certificate of conformity issued by the conformity assessment body of another country.

In the absence of certificates of conformity or a declaration of conformity, the imported products are subject to conformity assessment in accordance with the procedures applicable to such products and provided in the relevant national technical regulations.

According to the Law of the Republic of Moldova dated March 13, 2003 No. 105 On Protection of Consumer Rights, only safe products must be supplied to the country's market, which must be accompanied by certificates or declarations of conformity, other documents in accordance with the law, as well as products that meet the established or declared requirements.

The Consumer Protection Law of March 13, 2003 No. 105-XV prescribes that product information must contain all the information necessary to help the consumer make an informed decision when purchasing products.

The labeling of imported goods must contain the following information:

- name and address of the importer;

- product name, including trade name (if any);

- name and address of the manufacturer;

- net weight of products (metric system);

- the date of production, packaging and import of products.

According to the Law of 09/01/1989 No. 3465 "On the Functioning of Languages on the Territory of Moldova" the names of goods, labels (tags) of goods, markings, instructions for goods, as well as any visual information, are drawn up in the Moldovan (state) and Russian languages.

Requirements for food labeling, presentation and advertising and food labeling are set out in government decisions, which are mandatory.

The National Food Safety Authority (NFSA) is responsible for establishing and interpreting such Decisions, as well as for most of the food quality regulations for specific categories of consumers.

The Law of 02.07.2010 No. 142 "On Energy Efficiency" regulates activities aimed at reducing energy intensity in the national economy and reducing the negative impact of the energy sector on the environment.

Law of 27.03.2014 no. 44 On Labeling of Energy Consuming Products” establishes the legal framework for regulating national measures regarding the labeling and standard information on energy consuming products intended for end users, in particular on the consumption of energy consuming products and, as appropriate, other basic resources, as well as additional information.

This law provides a partial transposition of Directive 2010/30 / EC of the European Parliament and of the Council of 19 May 2010 on the indication by labeling and provision of standard product information - information on the consumption of energy-using products of energy and other basic resources, published in the Official Journal of the European Union L 153 dated June 18, 2010.

The law applies to household appliances and other energy-consuming products that directly or indirectly affect the consumption of energy and, as the case may be, other basic resources during use.

Energy labeling (Figure 2) characterizes products from A (most efficient) to G (least efficient) and is required for display at the point of sale on household energy-using products.

Refrigerators and freezers have two additional ratings, A + and A ++. The new A +, A ++ and A +++ energy ratings for refrigerators, washing machines and dishwashers will become mandatory for all new models on the market.

Products are rated by their energy consumption in kWh (units of energy used per hour). Thus, the less kWh is used, the more efficient the device.

Before placing a product on the market, importers must ensure that the manufacturer has followed the appropriate conformity assessment procedure established by the competent Moldovan body. The amendment was prepared for the Law on Accreditation and Conformity Assessment No. 235 of December 1, 2011, with the exception of such an obligation.
